i found her missing about 5 this morning and actually followed the tracks for about 300 yards where some fucks loaded her up and took her away. i have full coverage, but i do not want to deal with the ins. company thinking i'm defrauding them. i filed the claim and i guess we'll see where it goes from there. i am just one real pissed off sumbitch right now. :x :x :x :x

i have been trying to find humor, but i was gonna keep this bike for a long long time, even if i got somethin new. i finally squeezed 25,328 miles....i was going for 100,000 :P
hopefully the ins. company will come through :? the deputy i reported it to said he wasn't suprised....that they have a terrible crime rate in Beavers Bend..........NOW SOMEBODY FUKIN TELLS ME!!!!!!!!!!!!!!!!!

any advice on how to handle the ins. company? i have never had to make a claim like this. i have made small claims and they(State Farm) were quick about it and easy to deal with, but i know this is major. i just know they are gonna screw with me and think that i staged it. the deputy, in no way, thinks i staged it. he has a good idea who might have took it, but he told me that it's prolly in many MANY pieces by now. like i didn't know that :roll:

plus......this is the bike they have paid for once to have repaired. will they deduct that from their settlement offer :?

Well if it has a salvaged title then it probably is worth less. You need to get the book value from a dealer on actual value from the blue book. Then stick to it if they send you a check dont cash it if it doesnt equal the value,"If you cash it then you just settled with them". If they buck your choices are to settle or hire a lawyer. If you new someone in insurance buisness that could take up for you and help you out that would be a good avenue. Remember if you use a lawyer then you dont want it to go to court cause he will then get a big chunk of the pie. However if he just writes the insurance co. a letter that wont cost you much and may get you the results of a full settlement. Ive got an uncle in insurance and ill give him a call for you. Ill get back to you tommorow with what he said. :wink:

Talk with the dep. about the ins. thing. I bet he has dealt with it enough before, he could prolly stear you right. Plus, it sounds like he's on your side. Previous fixes don't mean a damn thing. It takes nothing from it's value. I wouldn't mess with a lawyer cause by the time they take there cut, on something like this, it wouldn't make a diff.

As far as a lawyer goes I said to have him write a letter,this is cheap but to go to court is costly.This I wouldnt do It isnt worth it. I was not advising him to sue. Ive been down this road plentey and I can tell you from experience that adjusters are paid premeums to low ball you. Take the advise, dont take the advise I dont give a shit. There is a big difference bettween collecting on a home owners policy and collecting on a automobile. Anyway Jimmy If you want me to talk to my uncle which has been in insurance for 45 years I will, just let me know.

Hey Truck, while youre at it, could you ask your Uncle how I could get max $ out of totaling my bike. The adjuster flat out told me that he doesnt know dick about bikes and would guess that it is totaled. Then he asked me how much I thought it was worth. If I wanted to fix the bike, he told me I would have to take it to a repair shop and request an estimate. I am in no shape to do that and dont want to pay for a bike I cant ride. I would like to get a check and pay off the note and buy a new bike next season when I am healthy again. Any onfo would be great. Sorry for bustin in on your thread Jimmy :wink:

OK guys I spoke to my uncle this afternoon and on both your accounts its the same thing. Go to three reputable dealers and get a salesman or salesmanager to give you a fair market value on the bike in writing taking in to account age and milage. Take the three written estimates to the insurance adjuster and give him a the written estimates ( It might be a good idea to keep copies for yourself). If his number is below the estimates he has to take the three and divide and get the difference between them and get a prajedted cost from the three, then that is the amount that you are to receive. If you get a check on the back of the check is a disclamer that says that if you cash the check then it is a settlement, he said to xxxxout this disclaimer and write in its place that you will not agree to those terms or just dont cash it until you get the full settlement. To people that do not know better this disclaimer isnt legit and cannot hold up in court. They have to give you fair market value. He did confirm that the adjuster gets kickbacks on lowballing you by the way and depending on who it is and how honest they are will depend on the settlement they offer you.

i got an update.

the ins. co. is considering it a total loss, since it hasn't been recovered yet. i have to sign over power of attorney (for the title....yeah i still owed the bank :roll: ) fill out an affidavit of theft (which is like writing a 5 page essay :roll: ) and get a letter of guaranty from my bank........ then they will send me my $8,300 check :eek: :eek: :eek:

i think i might just get me a new bike ......not sure yet.........................SHYEAH RIGHT :!: :!: :!: :!:

they are gonna give me $7,695 for the bike then they have to add TTL, inspection, etc etc...........just like if i went to buy one off the floor. if they do come through, i will be pleased. if i was to sell it, i prolly woulda asked 6,500
